Terms of Service

These terms are an agreement between you (and the company you sign up for) and Rental Clerk LLC, a Georgialimited liability company (“RentalClerk”, “we”, “us”). They cover your use of the RentalClerk website and software (the “Service”). By creating an account or using the Service, you agree to them. If you sign up for a company, you confirm you're allowed to agree for it.

1. The Service

RentalClerk is online software for equipment rental companies to manage inventory, quotes, scheduling, check-out and check-in, invoices and related work. We may improve, change or add features over time. Features described as “coming soon” are plans, not promises.

2. Your account

  • You must be at least 18 and give us accurate information.
  • Keep your password safe. You're responsible for what happens under your account and your team's accounts.
  • The account owner and admins control who on their team can use the account and what they can do.
  • Tell us right away if you think someone has used your account without permission.

3. Free trial, plans and payment

  • New accounts get a free 14-day trial. No card is needed to start.
  • After the trial, the Service is billed by subscription, monthly or yearly, at the prices shown on our pricing page when you subscribe. Prices exclude any applicable taxes.
  • Subscriptions renew automatically at the end of each billing period until cancelled. Payments are processed by our payment provider, Stripe; by subscribing you authorize recurring charges to your payment method.
  • We may change prices with at least 30 days' notice before your next renewal. Changes don't affect a period you've already paid for.
  • If a payment fails and isn't fixed, we may limit the account to read-only access until it is. We don't delete your data for a failed payment without notice.

4. Cancelling and refunds

You can cancel at any time from your account. Our Cancellation and Refund Policyexplains what happens when you do and when we give refunds. It's part of these terms.

5. Your data

  • Everything you put into RentalClerk (your inventory, customers, quotes, invoices and files) belongs to you. You give us permission to store and process it only to provide and support the Service.
  • You're responsible for having the right to the information you enter, including your customers' contact details, and for following the laws that apply to your business.
  • You can export your data while your account is active. After an account is closed, we keep data for 60 days so it can be restored on request, then delete it, except where we must keep records by law (such as billing records).
  • How we handle personal information is described in our Privacy Policy.

6. Acceptable use

You agree not to:

  • break the law, or use the Service to send spam or misleading, harmful or infringing content;
  • try to get into other companies' data, test or bypass our security, or disrupt the Service;
  • copy, resell or reverse-engineer the Service, or use it to build a competing product;
  • share one user's sign-in among several people to get around your plan's user limit.

We may suspend accounts that break these rules, and will tell you why unless the law or safety prevents it.

7. Our property

The Service, its software and design, and the RentalClerk name and logo belong to Rental Clerk LLC. These terms give you the right to use the Service while you're subscribed; they don't transfer any ownership. If you send us ideas or feedback, we may use them without owing you anything.

8. Availability and support

We work to keep RentalClerk available and your data backed up, but we can't promise the Service will never be interrupted or error-free. We may take it offline briefly for maintenance. Support is by email during normal business hours (Eastern time).

9. Disclaimers

The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. RentalClerk is a tool to help run your business: you remain responsible for your prices, taxes, contracts, equipment and the decisions you make with it, including checking quotes and invoices before you send them.

10. Limitation of liability

To the extent the law allows, Rental Clerk LLCwon't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if we were told they might happen. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim.

11. Indemnity

You agree to defend and hold Rental Clerk LLC harmless from claims by others arising from your data, your use of the Service in breach of these terms, or your dealings with your own customers.

12. Ending the agreement

You can stop using the Service and cancel at any time. We may end or suspend your access if you seriously or repeatedly break these terms, or if we stop offering the Service, in which case we'll give reasonable notice and refund any prepaid period you can't use.

13. Changes to these terms

We may update these terms. If a change is significant, we'll tell account owners by email or in the app at least 30 days before it takes effect. Continuing to use the Service after that means you accept the new terms.

14. Law and disputes

These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts in Cobb County, Georgia, and both sides agree to those courts' jurisdiction. Before going to court, please contact us; most problems can be solved quickly.
